Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Beaket web application at beaket.com (the "Service"), operated by Beaket ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years old and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Beaket is a decision graph platform that helps product teams record, connect, and trace decisions. The Service allows you to create and manage Specs, Briefs, ADRs, and other decision artifacts within teams and projects.

Features may change, and the Service may experience interruptions.

3. Account Registration

You access the Service by authenticating through Google OAuth. You are responsible for maintaining the security of your Google account. You agree to provide accurate information and to notify us if you become aware of any unauthorized use of your account.

4. User Content

Ownership

You retain ownership of all content you create through the Service, including Specs, Briefs, ADRs, comments, and other materials ("User Content").

License to Beaket

By submitting User Content, you grant Beaket a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your User Content solely for the purpose of operating and providing the Service.

Content Visibility

User Content is visible to members of your teams within the Service. You are responsible for the content you create and share.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Interfere with or disrupt the Service or its servers
  • Upload malicious code or content
  • Impersonate another person or entity
  • Scrape, crawl, or use automated means to access the Service without permission
  • Use the Service to store or transmit content that infringes intellectual property rights

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Beaket and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

7. Third-Party Services

The Service integrates with third-party services including Google (authentication), GitHub, and Atlassian (Jira, Confluence). The Service also allows embedding content from external sources such as Figma via URL. Your use of these integrations and embedded content is subject to the respective third-party terms of service. We are not responsible for third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BEAKET DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FEATURES MAY CHANGE OR BE REMOVED WITHOUT NOTICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases, but provisions that by their nature should survive (including Sections 4, 8, 9, and 11) will remain in effect.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Japan, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tokyo, Japan.
